These Terms and Conditions (the "Terms") apply to every purchase in the online store CM Store at store.cmindustry.co (the "Store"). They tell you who we are, what you buy, how the contract is made, how the files are delivered, what you may do with them and what your rights are. Please read them before you place an order. At checkout you confirm that you agree to them.
1. Who we are
The Store is operated by:
| Seller | Stanislav Tarasov, a self-employed entrepreneur (OSVČ) registered in the Trade Licensing Register (živnostenský rejstřík) kept by Úřad městské části Praha 15 |
|---|---|
| Brands | CM Store and CM Industry are brand names of the Seller, not separate companies |
| Registered address | náměstí Přátelství 1518/3, 102 00 Praha 10 – Hostivař, Czech Republic |
| Business ID (IČO) | 23724391 |
| Tax ID (DIČ) | CZ687884717. The Seller is registered for VAT as an identified person (identifikovaná osoba) and is not a VAT payer |
| store@cmindustry.co | |
| Phone | +420 777 672 378 (no fixed hours; e-mail is the fastest way to reach us) |
In these Terms the Seller is also referred to as "we" or "us". We have not signed up to any code of conduct.
2. Scope and definitions
2.1 "You" or "Customer" means the person who places an order in the Store. A "Consumer" is an individual who buys outside the scope of their business or profession. A "Business Customer" is anyone else, for example a company, a design studio or a wrap shop buying for its business. Provisions marked "for Consumers" or "for Business Customers" apply only to that group.
2.2 "Files" or "Digital Content" means the digital products sold in the Store: vehicle templates, graphic assets and pre-made liveries.
2.3 These Terms form part of every contract concluded through the Store. Anything we agree with you individually in writing (including by e-mail) takes precedence over these Terms.
2.4 Custom design work ordered outside the Store, for example through cmindustry.co, is governed by a separate agreement, not by these Terms.
3. Products
3.1 Vehicle templates are layered PSD files for Adobe Photoshop that show a vehicle model from one or more sides. They are used to design and present liveries. They are visual representations of the vehicle, not technical drawings or production patterns, so measure the real vehicle before you produce anything from a design.
3.2 Graphic assets are vector or raster design elements (for example patterns, flames or stripes) in the formats listed on the product page, such as AI, PDF, SVG or EPS.
3.3 Pre-made liveries are print-ready vector livery designs (for example AI and PDF) that you can download immediately after payment. The design is not exclusive: other customers may buy the same design. The price also includes adapting the design to your vehicle if you ask for it (see section 6.3).
3.4 The product page states the main characteristics of each product: what is included, file formats, resolution or scale, and the software needed to use it. Files are delivered as RAR archives, so you need an unpacking tool (for example WinRAR, 7-Zip or The Unarchiver) and software that can open the stated formats, usually Adobe Photoshop or Adobe Illustrator. We do not guarantee compatibility with other software.
3.5 Product images are illustrations. Logos, sponsor graphics and backgrounds shown in previews are for demonstration only and are not included in the Files unless the product page says otherwise. Colours may look different on your screen and in print.
3.6 Vehicle makes, model names and logos are trademarks of their owners and are used only to describe which vehicle a product fits. We are not affiliated with, endorsed by or connected to any vehicle manufacturer.
4. Prices and payment
4.1 All prices are in US dollars (USD) and are final. Because the Seller is not a VAT payer, no VAT is added. There are no delivery charges.
4.2 You pay in advance during checkout using one of the methods offered there, for example PayPal, a payment card or Apple Pay. Payments are processed by our payment providers PayPal and Stripe. We never see or store your full card number.
4.3 If your account is in another currency, your bank or payment provider may charge currency conversion or foreign transaction fees. These are not charged by us.
4.4 The order confirmation e-mail serves as your receipt. If you need an invoice with your company details, e-mail us your order number.
4.5 Discount codes and promotions apply only under the conditions stated with them and cannot be combined unless stated. Whenever we announce a price reduction, we also show the lowest price of the product in the 30 days before the reduction.
5. How the contract is concluded
5.1 Products shown in the Store are an invitation to make an offer. Your order is your offer to buy.
5.2 To order, you:
- add products to the cart;
- go to checkout and enter your e-mail address (as a guest, or sign in to or create a customer account);
- enter your billing details;
- choose a payment method;
- check the order summary and correct any mistakes, using "Edit cart" or by going back to the previous steps;
- tick the box to agree to these Terms and to ask for the Files to be supplied immediately (see section 8);
- confirm the order with the button "Buy now", which means an order with an obligation to pay, and complete the payment.
5.3 The contract is concluded when we accept your order by sending the order confirmation e-mail to the address you entered. This usually happens immediately after the payment is confirmed. The e-mail contains the order details, the key contract information and the full text of these Terms.
5.4 The contract is concluded in English. We store the concluded contract (your order) electronically. You can see it in the confirmation e-mail and, if you have a customer account, under "Orders". It is not accessible to third parties.
5.5 We may refuse or cancel an order in justified cases, for example if the payment was not completed, there is reasonable suspicion of fraud, or there was an obvious error in the price. Any amount already paid will be refunded without undue delay.
5.6 You bear the costs of your own internet connection and other means of distance communication.
5.7 You must be at least 18 years old to place an order, or have the consent of a parent or legal guardian.
6. Delivery of the files
6.1 Access. All products are delivered online. No physical goods are shipped. Once your payment is confirmed, we make the Files available through download links in an e-mail to the address used at checkout and, if you have a customer account, under "Orders" in your account. This usually happens within minutes. If a payment or security check is needed, it can take longer; in that case we will let you know and grant access without undue delay.
6.2 Download limits. Download links are valid for 15 days and allow up to 5 downloads per order. Please save the Files on your own device and keep a backup. If a link expires or the limit is used up, write to us and we will restore access free of charge. The Files are delivered when the download link is made available to you.
6.3 Adapting a pre-made livery to your vehicle. The price of a pre-made livery includes adapting the design to your vehicle:
- To use this service, e-mail us your order number and vehicle details within 6 months of your order: make, model, year, body version (including any body kit or aero parts) and, if possible, photos or measurements.
- We deliver the adapted files within 7 business days of receiving complete vehicle details, by e-mail or as a new download link.
- The adaptation includes any number of adjustments needed to fit the purchased design to your vehicle, within the original design. A different concept, new graphic elements, logos or sponsors, or adapting the design to another vehicle is a new order, priced by agreement.
- If the design cannot be adapted to your vehicle, for example because no reliable reference for its shape is available, we will tell you without undue delay after receiving your details and agree a solution with you, such as a partial refund.
- Printing and installation are done by a print shop or installer of your choice. Check the dimensions, scale and colours with them before printing. We are not responsible for printing or installation, or for the materials used.
7. Licence
The Files are protected by copyright. When you pay for a product, you receive a non-exclusive licence to use it as described in our License Agreement, which is part of the contract. In short:
- you may use the Files in your own and your clients' projects, commercial and non-commercial;
- you may deliver final designs, renders and print files to your clients;
- you may not resell, share or redistribute the Files themselves, or pass them on as source files, templates or asset packs.
8. Right of withdrawal
8.1 The general rule. A Consumer may normally withdraw from a contract concluded at a distance within 14 days of its conclusion without giving a reason (Section 1829 of the Czech Civil Code).
8.2 Digital content. Our Files are digital content that is not supplied on a tangible medium, and they are delivered immediately after payment. Before you place the order, at checkout you therefore:
- expressly ask us to supply the Files before the 14-day withdrawal period ends; and
- acknowledge that you lose your right of withdrawal once the Files have been supplied.
Once we make the download link available to you, you no longer have the right to withdraw from the contract (Section 1837(l) of the Czech Civil Code). We confirm your request and acknowledgement in the order confirmation e-mail. Your rights for defective Files (section 9) are not affected.
8.3 Before delivery. If the Files have not been made available to you yet, for example because a payment check is still running, you can still withdraw until they are delivered.
8.4 Pre-made liveries. The livery files are digital content, so the right of withdrawal ends when they are supplied, as described in 8.2. The adaptation included in the price (section 6.3) is a service that we start only when you send us your vehicle details. If you send them within the 14-day withdrawal period, you thereby ask us to start the adaptation before the period ends, and you acknowledge that you lose the right of withdrawal once the adaptation is complete (Section 1837(a) of the Czech Civil Code). If you still have a right of withdrawal and withdraw while the adaptation is in progress, you pay a proportionate part of the price for the work already done (Section 1834 of the Czech Civil Code).
8.5 How to withdraw. Where you still have the right to withdraw, send us a clear statement before the period ends. You can:
- e-mail us at store@cmindustry.co;
- use the online withdrawal form; or
- use the model withdrawal form below.
You do not have to use the form. We will confirm receipt of your withdrawal by e-mail.
8.6 Refund. If you withdraw, we will refund all payments received from you without undue delay and no later than 14 days after we receive your withdrawal. We use the same payment method you used, unless you expressly agree otherwise. You will not pay any fees for the refund.
8.7 Business Customers. Business Customers do not have a right of withdrawal.
9. Defective files and complaints
9.1 What we are responsible for. We are responsible for the Files corresponding to the contract when they are supplied:
- they match the product description;
- they have the stated formats, content and functions;
- they open in the stated software;
- they are not damaged or incomplete.
Where needed, we also provide updates that keep them in conformity (Sections 2389a and following of the Czech Civil Code).
9.2 Time limit for Consumers. Consumers can exercise their rights for a defect that becomes apparent within two years after the Files were supplied.
9.3 What is not a defect:
- incompatibility with software, a version or hardware that the product page does not list as supported, provided you were informed of the requirements before buying;
- colour differences between screens or between screen and print;
- problems caused by your own changes to the Files;
- problems caused by printing, materials or installation done by third parties.
9.4 How to complain. E-mail store@cmindustry.co with:
- your order number;
- a description of the problem;
- where possible, a screenshot or the error message and the software version you use.
We will confirm receipt of the complaint by e-mail, stating when it was made, what it concerns, what remedy you asked for and how we will contact you. Please cooperate with us as far as reasonably necessary to find out whether the problem is caused by your own software or hardware.
9.5 Resolution and remedies. We will resolve a Consumer's complaint, including any remedy, without undue delay and no later than 30 days after it was made, unless we agree a longer period. We will first bring the Files into conformity free of charge, usually by supplying a corrected file or a new download link. If that is not possible, if we do not do it within a reasonable time, or if the defect is serious, you can ask for an appropriate price reduction or terminate the contract. We will refund the amount due within 14 days.
9.6 Business Customers must report a defect without undue delay and no later than 30 days after the Files were supplied. Our liability towards them is limited as stated in section 12.
10. Customer account
You can buy as a guest or create a customer account. In the account you can see your orders and download links. Keep your password secret; you are responsible for activity in your account. We may suspend an account that is misused, for example to share download links. You can ask us to delete your account at any time (see the Privacy Policy).
11. Product reviews
Any visitor can write a review of a product:
- No purchase check. We do not check whether the author of a review has bought the product. Reviews are published automatically after they are submitted.
- What we remove. We remove reviews with unlawful or offensive content, with other people's personal data, or clearly unrelated to the product.
- What we do not do. We do not edit reviews, and we do not pay or give discounts for reviews.
12. Liability
12.1 Nothing in these Terms limits liability that cannot be limited by law. This includes a Consumer's statutory rights, liability for damage caused intentionally or by gross negligence, and liability for harm to life or health.
12.2 You are responsible for how you use the Files and the designs you create with them, including:
- any trademarks, sponsor logos or other third-party material you add;
- whether a livery complies with traffic, vehicle registration or racing series rules;
- the final print and installation.
12.3 We are not liable for loss of Files that you did not save or back up; we will, however, restore your access as described in section 6.2.
12.4 For Business Customers, to the extent permitted by law, our total liability arising from a contract is limited to the price paid for the product concerned, and we are not liable for lost profit or indirect damage.
13. Personal data and cookies
How we process personal data is described in the Privacy Policy; how we use cookies is described in the Cookie Policy.
14. Complaints and out-of-court dispute resolution
14.1 If you are not satisfied, please e-mail us first at store@cmindustry.co. We will try to find a solution.
14.2 A Consumer may submit a dispute arising from the contract for out-of-court resolution to the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI), Ústřední inspektorát – oddělení ADR, Gorazdova 1969/24, 120 00 Praha 2, Czech Republic, website adr.coi.cz (information in English: coi.gov.cz). Consumers in another EU country can also ask the European Consumer Centre in their country for help.
14.3 Our activities are supervised by:
- the Czech Trade Inspection Authority (consumer protection), coi.gov.cz;
- the Trade Licensing Office of Úřad městské části Praha 15, within the scope of the Trade Licensing Act;
- the Office for Personal Data Protection (ÚOOÚ), as regards personal data.
15. Governing law
15.1 Contracts concluded through the Store are governed by Czech law, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection. The UN Convention on Contracts for the International Sale of Goods does not apply.
15.2 If you are a Consumer with your habitual residence in another country, this choice of law does not deprive you of the protection given by the mandatory provisions of the law of your country.
15.3 Disputes with Business Customers are decided by the Czech courts having jurisdiction according to the Seller's registered address. A Consumer may also bring proceedings in the courts of the country where they live.
16. Final provisions
16.1 We may change these Terms, for example when the law or our services change. Each order is governed by the version in force when the order was placed. The current version is always on this page, with its date at the top.
16.2 If any provision of these Terms is invalid or unenforceable, the remaining provisions stay in force.
16.3 We communicate with you by e-mail at the address you used at checkout or in your account.
16.4 These Terms take effect on 8 October 2026.
